Montis in the Wild – Terms & Conditions

Welcome to Montis in the Wild, a customer photo submission program operated by Montis Pickleball ("Montis," "we," "us," or "our").

By submitting a photograph, image, caption, or other content through the Montis in the Wild program (the "Program"), you acknowledge that you have read, understand, and agree to these Terms & Conditions ("Terms").

Participation is voluntary. By checking the agreement box and submitting your content, you expressly consent to the uses and permissions described below.

1. Program Overview

Montis in the Wild invites customers to share original photographs of themselves wearing Montis Pickleball footwear in everyday life, on the pickleball court, at tournaments, during travel, or in other appropriate settings.

Eligible participants who submit qualifying photographs may receive a $10 Montis Pickleball digital gift card, subject to review, approval, and the conditions outlined in these Terms.

Submission does not guarantee approval, compensation, publication, or participation in any Montis marketing campaign.

2. Eligibility

To participate, you must:

Be at least 18 years of age.
Submit a photograph that you own or are legally authorized to submit and license.
Have the necessary permission from every identifiable person appearing in the photograph.
Submit accurate contact information, including a valid email address.
Comply with these Terms and all applicable laws.

Montis may request reasonable verification of eligibility, ownership, or consent before approving a submission.

3. Photo Submission Requirements

Submitted photographs must:

Clearly feature genuine Montis Pickleball footwear.
Be original content or content you have the legal right to submit and license.
Be reasonably clear and suitable for potential marketing use.
Not contain unlawful, defamatory, obscene, hateful, discriminatory, or otherwise inappropriate material.
Not infringe another person's copyright, trademark, privacy, publicity, or other legal rights.
Not contain third-party logos, artwork, or other protected material unless you have the necessary permissions for Montis's intended use.

Montis reserves the right to approve, reject, or remove submissions at its reasonable discretion based on these requirements, brand suitability, suspected fraud, or legal concerns.

4. Ownership and Authority to Submit

By submitting content, you represent and warrant that:

You are the original creator and copyright owner of the submitted content, or you have obtained all necessary rights and permissions to submit it and grant the license described in these Terms.
If someone else took the photograph, including a friend, family member, or professional photographer, you have obtained that person's permission to license the photograph to Montis for the uses described here.
You have obtained all necessary permissions and releases from identifiable individuals appearing in the content, including permission for their image and likeness to be used in commercial advertising and promotional materials.
The submission and Montis's authorized use of the content will not violate any copyright, trademark, privacy, publicity, contractual, or other third-party rights.
You have not granted any conflicting rights that would prevent Montis from using the content as permitted under these Terms.
All information provided in connection with your submission is accurate and truthful.

You acknowledge that simply appearing in a photograph does not necessarily mean you own the copyright or have the right to authorize its commercial use.

You are responsible for obtaining the necessary permissions before submitting.

5. License and Permission Granted to Montis

By submitting your content and accepting these Terms, you grant Montis Pickleball, its affiliated companies, successors, assigns, authorized marketing partners, advertising agencies, service providers, and licensees a non-exclusive, worldwide, perpetual, irrevocable (to the extent permitted by applicable law), transferable, sublicensable, fully paid-up, and royalty-free license to use your submitted content.

This license includes the right to:

Reproduce, copy, publish, display, distribute, and share the content.
Edit, crop, resize, enhance, adapt, format, and otherwise modify the content.
Incorporate the content into advertisements, promotional campaigns, videos, graphics, product listings, and other creative materials.
Use the content in paid and organic social media marketing.
Use the content on Montis websites, online stores, landing pages, and product pages.
Use the content in email campaigns, newsletters, digital advertisements, print advertisements, brochures, catalogs, and other promotional materials.
Use the content in retail displays, trade shows, presentations, and other business or promotional settings.
Create derivative works incorporating the content.
Authorize advertising platforms, agencies, contractors, and other service providers to use the content on Montis's behalf.
Continue using the content in future marketing campaigns without obtaining additional approval.

This permission applies to all media and formats, whether currently existing or developed in the future, in connection with Montis's business, products, and promotional activities.

Montis is not required to notify you, obtain additional approval, or provide additional compensation before using content within the scope of this license.

You retain ownership of any copyright you hold in your original content. This license does not transfer copyright ownership to Montis.

6. Permission to Use Your Name, Image, and Likeness

By participating, you expressly authorize Montis to use your appearance, image, likeness, and other identifying visual characteristics contained in the submitted photograph for commercial, advertising, marketing, and promotional purposes.

If you provide your first name, general location, caption, or accompanying story, you also authorize Montis to use that information in connection with the submitted content.

Montis may identify you by first name and general location, but will not intentionally publish your email address, telephone number, or other private contact information as part of the Program.

You understand that your photograph may be used in advertisements promoting Montis products, including advertisements intended to generate sales.

You authorize these uses without requiring additional notice, approval, royalties, or compensation beyond any Program reward for which you qualify.

Montis will not knowingly attribute a fabricated testimonial or specific product-performance claim to you.

7. Editing and Creative Use

You understand and agree that Montis may modify submitted content for legitimate advertising, branding, formatting, and promotional purposes.

Such modifications may include cropping, color correction, adding text, incorporating Montis logos, combining the photograph with other creative materials, and adapting it to different advertising formats.

To the extent permitted by applicable law, you waive any moral rights or similar rights that would prevent the uses expressly authorized by these Terms.

Montis will not knowingly alter content in a manner that falsely attributes a specific statement or endorsement to you or is otherwise unlawful.

8. No Additional Compensation or Approval Required

You acknowledge and agree that:

Any $10 gift card issued under the Program is the only compensation owed for an approved submission.
Montis may use approved submitted content multiple times, across multiple channels, and for an unlimited number of campaigns.
You will not be entitled to additional payments, royalties, licensing fees, residuals, or other compensation for authorized uses.
You will not have approval rights over individual advertisements, designs, placements, or marketing campaigns using the content within the scope of these Terms.
Montis is not obligated to publish or otherwise use any submitted content.

The license granted under these Terms is effective upon submission and acceptance of these Terms, regardless of whether a gift card is ultimately issued.

9. $10 Gift Card Reward

Montis may issue a $10 Montis Pickleball digital gift card for an eligible photo submission that meets the Program requirements and is approved by Montis.

The following conditions apply:

Limit one $10 gift card per customer for the lifetime of the Program.
Each customer is eligible to receive only one reward, regardless of how many photographs they submit.
Gift cards are issued only after Montis reviews and approves the submission.
Duplicate, previously rewarded, fraudulent, or otherwise ineligible submissions will not qualify for additional rewards.
Gift cards will be delivered electronically to the email address provided during submission.
Gift cards are redeemable through the Montis Pickleball online store, subject to applicable gift card terms and laws.
Gift cards are not redeemable for cash except where required by law.

Montis reserves the right to verify eligibility and withhold rewards where there is a reasonable basis to believe these Terms have been violated.

10. No Guarantee of Publication

Submission or approval of a photograph does not guarantee that Montis will publish, feature, or use the content.

Montis may select photographs based on creative needs, marketing objectives, image quality, brand suitability, and other legitimate business considerations.

Montis may discontinue use of any photograph at any time.

11. Duration of Permission and Requests to Stop Use

The content license granted under these Terms is intended to be perpetual and, to the extent permitted by applicable law, irrevocable.

This allows Montis to continue using authorized content in existing and future promotional materials without needing to renegotiate permission for each use.

However, if you have concerns about a photograph or wish to request that Montis discontinue future use, you may contact info@montispickleball.com.

Montis will review such requests in good faith and comply with applicable legal requirements.

You understand that content may already have been published, distributed, printed, shared, or incorporated into advertising campaigns. Removal from third-party platforms, previously distributed materials, or existing publications may not always be technically or practically possible.

Nothing in these Terms limits rights to withdraw consent or request removal where such rights cannot legally be waived.

12. Third-Party Rights and Claims

You agree that you will not knowingly submit content that violates another person's legal rights.

You are responsible for obtaining any required copyright licenses, model releases, or other permissions before submission.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Montis, its officers, employees, affiliates, and authorized representatives from third-party claims, damages, liabilities, and reasonable legal expenses arising from your material breach of the ownership, authorization, or third-party permission representations in these Terms.

This provision does not require you to indemnify Montis for claims arising from Montis's unauthorized use, negligence, misconduct, or alterations outside the scope of the rights you granted.

13. Privacy and Personal Information

Montis collects information submitted through the Program, which may include your name, email address, photograph, location or caption, and confirmation of your acceptance of these Terms.

Montis may use this information to:

Administer and operate the Program.
Review submissions and verify eligibility.
Communicate about submissions and rewards.
Issue gift cards.
Maintain records of permissions and licenses.
Publish and promote approved content as authorized under these Terms.
Prevent fraud and enforce Program rules.

Personal information is handled in accordance with our Privacy Policy, available at https://montispickleball.com/policies/privacy-policy.

Participation in the Program does not automatically constitute consent to receive unrelated promotional emails or SMS messages. Any marketing subscription consent will be collected separately where required.

14. No Employment, Partnership, or Endorsement Agreement

Participation in Montis in the Wild does not create an employment, agency, partnership, sponsorship, ambassador, or independent contractor relationship between you and Montis.

Receiving a gift card does not make you an official Montis representative or sponsored athlete.

Montis may identify submitted content as customer-generated content where appropriate and will comply with applicable advertising disclosure requirements.

Participants who separately publish promotional content or endorsements may have their own disclosure obligations under applicable advertising laws.

15. Program Changes, Suspension, and Termination

Montis reserves the right to modify, suspend, or discontinue the Program at any time.

Changes to reward amounts, eligibility requirements, submission limits, or other Program rules will apply prospectively unless otherwise permitted by law.

Material changes to the content license will not expand the rights granted for previously submitted content without any additional consent required by applicable law.

Discontinuing the Program does not automatically terminate content licenses previously granted under these Terms, subject to applicable law.

16. Limitation of Liability

To the maximum extent permitted by applicable law, Montis will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from participation in the Program or authorized use of submitted content.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limits your non-waivable statutory rights.

17. Governing Law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law principles, except where mandatory laws of another jurisdiction apply.

Any disputes will be handled in accordance with applicable law and any enforceable dispute-resolution provisions governing the parties.

18. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.

19. Entire Agreement

These Terms, together with the applicable Montis Privacy Policy and gift card terms, govern participation in the Montis in the Wild Program.

If a provision of these Terms conflicts with a mandatory requirement of applicable law, the applicable law controls.

21. Electronic Acceptance

By checking the required agreement checkbox and submitting your photograph through the Montis in the Wild submission form, you acknowledge and agree that:

You have read and understood these Terms & Conditions.
You are at least 18 years old.
You own or control the necessary rights to submit the photograph and grant the permissions described.
You have obtained all required permissions from identifiable individuals appearing in the photograph.
You expressly authorize Montis to use your photograph, image, and likeness for commercial advertising, marketing, and promotional purposes.
You understand that Montis may use the content without further notice, approval, or additional compensation.
You agree to the Program eligibility and reward requirements.
