Montis Ambassador & Affiliate Program Terms & Conditions

These Montis Ambassador & Affiliate Program Terms & Conditions ("Terms") govern participation in the Montis Ambassador and Affiliate Programs (collectively, the "Program") offered by Montis Pickleball LLC ("Montis," "we," "us," or "our").

An "Ambassador" means an approved Program participant who generally earns Montis store credit or other non-cash Program rewards for Qualifying Referral Sales. An "Affiliate" means an approved Program participant who is specifically authorized by Montis to earn monetary commissions for Qualifying Referral Sales. Ambassadors and Affiliates are collectively referred to as "Program Participants."

1. Eligibility and Acceptance

Enrollment in the Program does not automatically guarantee acceptance. Montis may review applications and determine Program eligibility at its discretion.

Where an enrollment purchase is required, an Ambassador account may not become active until the required purchase has been completed and any other enrollment requirements have been satisfied.

Montis reserves the right to accept or decline applicants and to suspend or remove Program Participants when reasonably necessary to protect the Program, Montis customers, or the Montis brand.

Program Participants must generally be at least 18 years old unless Montis has provided written approval for participation by a minor with appropriate parent or legal guardian consent.

Electronic Acceptance. By submitting an application to the Program, checking a box indicating acceptance of these Terms, completing any required enrollment process, or otherwise electronically accepting these Terms, the Program Participant acknowledges that they have read, understood, and agree to be bound by these Terms. Electronic acceptance has the same force and effect as a written signature to the extent permitted by applicable law.

2. Program Benefits

Program benefits may include personal referral links or discount codes, customer discounts, Montis store credit, monetary commissions for approved Affiliates, product opportunities, promotional opportunities, access to Program resources, or other benefits designated by Montis.

Benefits may vary by participant, Program segment, tier, campaign, product, or promotion. Participation in the Program does not guarantee any particular benefit.

3. Customer Discount

Montis may provide Program Participants with a personal referral code or link that provides referred customers with a discount on eligible Montis purchases.

Unless otherwise communicated by Montis, the standard customer discount may be 10%. Montis may change the discount percentage, eligible products, exclusions, stacking rules, or availability at any time.

Program discount codes are intended to support genuine referral and promotional activity and may not be represented as an official public Montis coupon unless Montis has authorized that use.

4. Ambassador Rewards

Approved Ambassadors may earn rewards on Qualifying Referral Sales. Unless otherwise specified by Montis, Ambassador rewards are issued as Montis store credit and are not payable in cash.

Unless otherwise communicated by Montis, the standard Ambassador reward may be 15% of eligible net sales in Montis store credit. Reward rates may vary by Ambassador, tier, campaign, or promotion.

Store credit is subject to the Store Credit provisions below and may be adjusted when an underlying transaction is returned, refunded, canceled, charged back, incorrectly attributed, fraudulent, or otherwise ineligible.

Ambassador store credits are generally subject to a minimum 30-day approval period following the qualifying purchase before becoming eligible for payment.

5. Affiliate Commissions

Certain Program Participants may be separately approved by Montis as Affiliates. Approved Affiliates may receive monetary commissions rather than Montis store credit at the commission rate specifically assigned to their Affiliate account.

Commission rates, payment schedules, payout thresholds, payment methods, and other Affiliate compensation terms may vary by Affiliate and will be communicated by Montis or displayed within the Affiliate's Program account.

Affiliate commissions are earned only on Qualifying Referral Sales and remain subject to these Terms, including referral attribution, returns, refunds, cancellations, chargebacks, fraud, discount-code leakage, Program manipulation, and Program Administration provisions.

Montis may require Affiliates to provide payment, identity, or tax information reasonably necessary to process monetary commissions or comply with applicable law.

Affiliate commissions are generally subject to a minimum 30-day approval period following the qualifying purchase before becoming eligible for payment.

6. What Is a Qualifying Referral Sale?

The purpose of the Program is to compensate Program Participants for customers and sales that result from their genuine promotional efforts.

Qualifying promotional activity may include social media content, videos, reviews, personal recommendations, participation in the pickleball community, events, clinics, tournaments, conversations, referral links, and other genuine activities that introduce customers to Montis or materially contribute to a sale.

A transaction may be considered a Qualifying Referral Sale when Montis reasonably determines that the Program Participant's promotional efforts contributed to the customer's discovery of, interest in, or purchase from Montis and the transaction otherwise complies with these Terms.

Use of a Program Participant's discount code or referral link is an attribution signal, but code or link use alone does not necessarily establish a Qualifying Referral Sale or guarantee a Program reward.

Montis reserves the right to determine whether a transaction reasonably qualifies under the Program.

7. Discount Code Leakage and Public Distribution

Program discount codes may sometimes be copied, scraped, indexed, reposted, or otherwise distributed beyond a Program Participant's intended audience without the participant's knowledge.

This may occur through coupon or deal websites, discount aggregators, search-engine results, browser or coupon extensions, cashback services, automated tools, forums, social posts, or other third-party sources.

When this occurs, customers who were already intending to purchase from Montis may locate and use a Program Participant's code even though the Program Participant did not introduce the customer to Montis or materially contribute to the sale.

Transactions resulting primarily from this type of public code discovery may not qualify for Ambassador rewards or Affiliate commissions.

The existence of a discount code on a third-party website does not, by itself, establish that the Program Participant intentionally distributed it there.

8. Intentional Coupon-Site Distribution

Program Participants may not intentionally submit, upload, distribute, promote, syndicate, or provide their Program discount code to coupon websites, discount aggregators, browser extensions, cashback services, automated coupon tools, paid-search campaigns, or similar services without Montis's prior written permission.

Program Participants may promote their codes through legitimate personal content, social media, videos, reviews, communities, events, conversations, email audiences they are legally permitted to contact, and other genuine promotional activities.

If Montis determines that a participant intentionally distributed a code through an unauthorized coupon or deal channel, Montis may exclude related transactions, deactivate the code, adjust or reverse rewards, suspend the participant, or terminate Program participation.

9. Leaked Code Procedure

If Montis believes a Program code has become publicly indexed or distributed beyond the Program Participant's genuine promotional audience, Montis may review the circumstances and referral activity.

Montis may contact the Program Participant, exclude transactions that Montis reasonably determines are not attributable to the participant's promotional efforts, deactivate or retire the affected code, issue a replacement code, modify attribution methods, or take other reasonable steps to protect the Program.

Montis will endeavor to distinguish accidental code leakage from intentional Program abuse. Accidental third-party copying of a code does not automatically constitute a violation of these Terms.

10. Referral Links and Attribution

Montis may use referral links, cookies, discount codes, order information, referral identifiers, and other tracking methods to help determine attribution.

Referral tracking technology is not perfect. Cookies may be blocked or deleted, customers may use different devices or browsers, codes may be shared, and third-party systems may incorrectly attribute transactions.

Montis may review, correct, exclude, or otherwise adjust attribution when reasonably necessary to reflect the intent of the Program and these Terms.

A referral link, cookie, code, or other technical attribution event does not create an unconditional right to a Program reward.

11. Branded Search and Paid Advertising

Without Montis's prior written authorization, Program Participants may not bid on, purchase, target, or otherwise use paid advertising against Montis trademarks, brand names, product names, or branded coupon searches, including terms such as "Montis," "Montis Pickleball," "Montis Athletics," "Montis discount code," "Montis coupon," "Montis promo code," or similar variations.

Program Participants may not create advertisements, websites, domains, landing pages, social accounts, search listings, or other materials that impersonate Montis or create the misleading impression that they are Montis, an official Montis website, or an official Montis-operated discount source.

Montis may exclude transactions generated through unauthorized branded search or paid advertising and may take additional Program action where appropriate.

12. Self-Referrals

Program Participants may not use their own referral link or discount code primarily to generate rewards on their own purchases unless Montis has expressly authorized that use.

Montis may exclude or reverse rewards associated with self-referrals, circular transactions, coordinated purchasing arrangements, or other transactions designed primarily to generate Program compensation rather than genuine customer referrals.

13. Friends, Family, and Personal Referrals

Genuine recommendations to friends, family members, teammates, club members, students, clients, and other personal contacts may qualify for Program rewards when they otherwise satisfy these Terms.

The existence of a personal relationship between the Program Participant and the customer does not, by itself, disqualify a legitimate referral.

14. Content and Brand Representation

Program Participants must represent Montis, its products, pricing, policies, warranties, and offers accurately and in good faith.

Program Participants may not make false, misleading, deceptive, defamatory, or unsubstantiated claims about Montis, its products, competitors, or other persons or businesses.

Participants may share honest opinions and personal experiences, including balanced or critical feedback, provided they do not misrepresent facts or imply that Montis has approved statements that Montis has not approved.

15. Disclosure Requirements

Program Participants are responsible for complying with applicable advertising, endorsement, consumer-protection, social-media, and disclosure requirements.

When a material relationship with Montis must be disclosed, the disclosure should be clear and conspicuous and reasonably understandable to the audience.

Montis may provide disclosure guidance, but each Program Participant remains responsible for compliance with laws and platform rules applicable to their content.

16. Social Media and Content

Program Participants are encouraged to share genuine experiences with Montis and to promote Montis in ways that fit their own voice, audience, and community.

Unless separately agreed in writing, participation in the Program does not create a required posting schedule, minimum content obligation, sponsorship agreement, employment relationship, or authority to speak on Montis's behalf.

Montis may request that a participant correct or remove content that materially misrepresents Montis, violates these Terms, infringes third-party rights, or creates a material legal or brand risk.

17. Store Credit

Montis store credit issued through the Program has no cash value except where required by applicable law.

Store credit is personal to the Ambassador and may not be sold, assigned, or transferred unless Montis expressly permits it.

Montis may adjust, withhold, or reverse store credit associated with returns, refunds, cancellations, chargebacks, fraud, Program manipulation, attribution errors, coupon leakage, or transactions that otherwise do not qualify under these Terms.

Legitimately earned store credit issued before a Program change generally will be honored, subject to these Terms, fraud or error corrections, and applicable law.

18. Returns, Refunds, and Canceled Orders

Program rewards are based on eligible completed transactions. If an underlying transaction is returned, refunded, canceled, reversed, charged back, determined to be fraudulent, or otherwise becomes ineligible, the associated store credit or commission may be withheld, reduced, reversed, or deducted from future Program rewards or payments.

Montis may delay final approval or payout of rewards for a reasonable period to account for returns, refunds, cancellations, chargebacks, or fraud review.

Reward Approval Period. Referral transactions are subject to an approval period before the associated Ambassador store credit or Affiliate commission becomes eligible for issuance or payment. Montis generally reviews and approves eligible referral transactions approximately 30 days after the qualifying purchase to allow time for returns, exchanges, cancellations, refunds, chargebacks, fraud review, attribution review, and other adjustments.

A referral appearing as pending, tracked, or attributed within the Program dashboard does not mean that the referral has been finally approved or that a reward or commission has been earned.

Following the approval period, Montis will review eligible transactions and may approve, deny, adjust, or continue to hold a transaction when reasonably necessary to resolve a return, exchange, refund, chargeback, attribution issue, suspected fraud, Program violation, or other circumstance affecting eligibility.

Approved Ambassador rewards will be issued as store credit in accordance with the Program. Approved Affiliate commissions will become eligible for payment in accordance with the Affiliate's applicable payout schedule and payment terms.

19. Fraud and Program Manipulation

Program Participants may not engage in fraud, artificial traffic, fake referrals, fabricated transactions, duplicate or coordinated accounts, unauthorized incentives, cookie stuffing, forced clicks, misleading redirects, automated traffic, unauthorized coupon distribution, or other conduct intended to manipulate Program tracking, attribution, discounts, or compensation.

Montis may investigate suspicious activity and may request information reasonably necessary to evaluate whether transactions comply with these Terms.

Transactions connected to fraud, manipulation, abuse, or material violations of these Terms may be denied, excluded, adjusted, or reversed.

20. Program Administration and Discretion

Montis has sole and final discretion to administer and interpret the Ambassador Program, Affiliate Program, and these Terms, including determining Program eligibility, Qualifying Referral Sales, referral attribution, reward eligibility and amounts, Program benefits, and compliance with these Terms.

Montis may approve, deny, exclude, adjust, or reverse any referral attribution, Ambassador reward, or Affiliate commission at any time if Montis determines that the transaction does not qualify under the Program, was incorrectly attributed, resulted from coupon leakage or public code distribution, involved fraud or Program manipulation, or otherwise does not comply with these Terms.

The use or acceptance of a Program discount code, referral link, cookie, or other tracking mechanism does not, by itself, guarantee that a transaction qualifies for a Program reward.

Montis's approval or payment of a reward in one instance does not require Montis to approve similar transactions in the future and does not constitute a waiver of Montis's right to interpret or enforce these Terms.

All Program eligibility, attribution, and reward determinations made by Montis are final, subject to applicable law.

21. Program Changes

Montis may modify customer discount percentages, Ambassador reward percentages, Affiliate commission rates, store-credit rules, payout procedures, attribution methods, qualification requirements, Program tiers, benefits, eligible products, technology, or these Terms.

When practicable, Montis will provide reasonable notice of material changes affecting future Program participation or compensation.

Program changes generally apply prospectively. Montis may apply corrections to prior activity when necessary to address fraud, Program abuse, attribution or administrative errors, legal requirements, returns, refunds, chargebacks, or transactions that were never eligible under the Program.

Montis may require Program Participants to electronically accept updated Terms before continuing to participate in the Program or receive future Program rewards.

22. Suspension or Termination

Montis may suspend or terminate a Program Participant for violation of these Terms, fraud, abuse, misleading conduct, unauthorized coupon distribution, material brand or legal risk, inactivity, or other legitimate Program-administration reasons.

Montis may also discontinue or restructure the Program, a Program segment, or an individual participant relationship, subject to applicable law and any separate written agreement.

A Program Participant may stop participating at any time by contacting Montis.

23. Effect of Termination

Following termination, the former Program Participant must stop representing themselves as a current Montis Ambassador or Affiliate and must cease unauthorized use of Program links, codes, materials, and benefits.

Pending rewards or commissions remain subject to validation under these Terms. Montis may withhold, adjust, or reverse amounts associated with ineligible transactions, fraud, abuse, returns, refunds, chargebacks, or violations of these Terms.

Termination does not eliminate obligations or rights that by their nature should survive termination, including provisions concerning attribution review, intellectual property, taxes, fraud, prior transactions, and enforcement.

24. Independent Relationship

Program Participants participate as independent persons or businesses and are not employees, agents, franchisees, partners, joint venturers, or legal representatives of Montis.

Program Participants have no authority to enter agreements, incur obligations, make warranties, or otherwise bind Montis.

25. Taxes

Program Participants are responsible for determining and satisfying taxes arising from rewards or commissions they receive to the extent required by applicable law.

Affiliates receiving monetary commissions may be required to provide tax forms, taxpayer identification information, or other documentation reasonably requested by Montis or its payment providers before payment is made.

Montis may withhold payments or reporting information where required by applicable law.

26. No Guarantee of Earnings

Participation in the Program does not guarantee referrals, sales, store credit, commissions, income, product opportunities, sponsorships, tournament support, or any particular level of compensation.

Results vary based on numerous factors, including the participant's promotional activity, audience, customer behavior, product availability, and Program rules.

27. Intellectual Property

Montis names, logos, trademarks, product names, photographs, graphics, videos, and other brand assets remain the property of Montis or their respective owners.

During active participation, Montis grants Program Participants a limited, revocable, non-exclusive, non-transferable permission to use approved Montis brand assets solely for legitimate Program promotion in accordance with these Terms and any brand guidelines provided by Montis.

Program Participants may not modify Montis trademarks in a misleading manner, register Montis trademarks or confusingly similar names, or claim ownership of Montis intellectual property.

28. Limitation of Program Benefits

Program benefits are personal to the approved Program Participant unless Montis expressly agrees otherwise.

Program accounts, codes, links, rewards, commissions, store credit, access, or other benefits may not be sold, assigned, transferred, sublicensed, or exploited for unauthorized commercial purposes.

Program participation does not create an entitlement to sponsorship, free products, tournament reimbursement, exclusivity, or other benefits not expressly offered by Montis.

29. Communication

Montis may communicate electronically with Program Participants regarding applications, account status, referrals, rewards, commissions, Program administration, product or promotional opportunities, policy updates, and other Program matters.

Program Participants are responsible for maintaining accurate contact information and reviewing Program communications reasonably related to their participation.

30. Questions and Attribution Disputes

Questions or good-faith disputes regarding referral attribution, store credit, commissions, or Program eligibility should be directed to Montis at info@montispickleball.com.

Montis may request information reasonably necessary to review the transaction or dispute. Montis will make the final Program determination in accordance with these Terms, subject to applicable law.

31. Our Program Philosophy

The Program exists to reward people who genuinely contribute to the growth of Montis and the pickleball community.

We want meaningful rewards to go to the recommendations, content, relationships, community involvement, and other efforts that introduce customers to Montis and help generate sales.

As the Program grows, Montis must distinguish genuine Program Participant referrals from customers who independently discover Montis and simply locate a publicly available discount code.

Our goal is not to penalize Ambassadors or Affiliates when a code is accidentally copied or leaked by a third party. Our goal is to maintain fair attribution, protect the integrity of the Program, and allow Montis to continue investing sustainably in the people who genuinely help grow the brand.
